On 22nd February 2012 the family arbitration scheme operated by the Institute of Family Law Arbitrators (IFLA) was launched. The IFLA scheme will have an impact on all family practitioners who are concerned with financial and property disputes. It is now possible for the parties to any such dispute to agree to arbitration rather than to use the court process. Unlike other forms of alternative dispute resolution, arbitration leads to an outcome which is binding on the parties.
Sir Hugh Bennett, Nicholas Francis QC and Timothy Scott QC are among those who have so far qualified as Members of the Institute. This seminar will look at the background and scope of the scheme as well as explaining the procedures of the arbitral process and how the scheme is likely to work in practice.
